Recently, a user claimed that Judge Analisa Torres is about to deliver a final ruling in the case that could redefine how digital assets like XRP are treated in the U.S. However, legal expert Bill Morgan quickly stepped in to clear things up. Morgan explained that this claim is ‘incorrect’. What’s actually happening is that both Ripple and the SEC have asked the court for an “indicative ruling,” a decision on whether there are special circumstances to reduce Ripple’s penalty and lift the existing ban on selling XRP to institutions. This ruling won’t decide the legal status of crypto assets in the U.S. The original summary judgment from July 2023, which declared that XRP is not a security in secondary market sales, will remain unchanged. “In fact the parties have agreed that the substantive summary judgment ruling made by Judge Torres in July 2023 will remain in place and will not be vacated, amended or modified,” Morgan wrote. There’s also been talk about a new settlement offer. One user claimed Ripple and the SEC just proposed a $50 million deal, down from an earlier $125 million. But Morgan clarified that the settlement was already agreed upon in April 2025 and approved by the SEC in early May. For now, both sides have asked the court to keep the case’s appeals on hold, with the SEC expected to file a status report by August 15, 2025.
